Important limitation and reliance notice

Research informs decisions. It does not make them for the client.

Use of the website or any Aperture output is subject to the agreed scope, evidence cut-off, professional boundaries and applicable law.

Domain and service identity

ApertureForensic.com does not turn every Aperture service into a forensic service.

ApertureForensic.com is the shared web and communications domain used within the broader Aperture environment. Aperture Research Works is the research and verification service presented on this website. The word “forensic” in the domain name describes the wider evidence-focused environment and does not, by itself, represent that Aperture Research Works is a forensic laboratory, forensic accounting practice, law-enforcement body, regulated investigator or provider of any reserved professional service.

Formal forensic examinations, laboratory work, regulated investigations, expert opinions or other reserved specialist services are included only when they are expressly identified, separately scoped and performed by an appropriately qualified service provider or specialist. The domain name does not expand Aperture Research Works’ qualifications, authority, legal powers or agreed assignment scope.

Research boundary

Where Aperture research starts, where it ends and what it does not include.

Defined beginning

Work starts only after written acceptance and is limited to the agreed Central Question, purpose, jurisdictions, source categories, supplied material, review period, deliverables and intended use.

Defined endpoint

Unless monitoring is separately agreed, the research ends at the stated evidence cut-off and delivery of the agreed output. Later events, later publications and changes after that point are not automatically reviewed.

Excluded work

Field investigation, surveillance, compulsory process, witness interviews, site visits, laboratory or device examination, formal forensic testing, legal opinion, regulated professional advice and specialist certification are excluded unless expressly and separately scoped.

Aperture may identify missing documents, unanswered questions, external confirmations or specialist work that could materially affect reliance. Identifying the need does not mean that Aperture has obtained or performed it. Further work requires a new or amended written scope. Where practical, the client should obtain missing documents, permissions, confirmations and external responses directly.

External communications

External letters, third-party contact and external enquiries are not included by default.

Aperture Research Works does not, unless a written proposal expressly says otherwise, send letters on a client’s behalf, contact subjects or third parties, request comment or right of reply, conduct interviews, submit records requests, approach regulators, make representations, obtain confirmations or undertake other external enquiries.

The client should ordinarily make those contacts and provide the resulting material to Aperture. If Aperture agrees to undertake a specific external communication, it must be separately scoped and approved in writing, with the sender identity, authority, wording, recipient, purpose, legal and safety considerations, fees and record-keeping route agreed beforehand. Aperture cannot guarantee delivery, acknowledgement, cooperation, accuracy or response.

No failure by a third party to respond, and no absence of a response that was outside the agreed scope, creates a representation that the underlying claim is true or false.

Client decision responsibility

The client retains full responsibility for every decision, action, omission, transaction, publication, strategy or reliance choice made after receiving Aperture’s work. The research is intended to support understanding and decision-making. It does not transfer responsibility for the client’s affairs to Aperture Research Works, Paul Hattingh, Xandro Hattingh, any contributor or research-support provider.

No guarantee

No report, dossier, memorandum, article, assessment, monitoring update or other output guarantees a commercial, legal, regulatory, financial, investment, reputational, political, investigative or other outcome. Findings remain limited by the agreed scope, evidence available, source quality, access constraints, jurisdiction and stated evidence cut-off.

Limitation of liability

To the fullest extent permitted by applicable law, Aperture Research Works, Paul Hattingh, Xandro Hattingh and associated contributors will not be liable for any direct, indirect, incidental, special, punitive or consequential loss, including loss of profit, revenue, opportunity, investment value, business, contract, data, reputation or anticipated savings, arising from use of or reliance on the website or an Aperture output.

This includes loss arising from client decisions, third-party conduct, inaccessible or inaccurate records, misleading or subsequently amended sources, events after the evidence cut-off, failure to obtain required specialist advice, or use beyond the agreed scope, jurisdiction, audience or intended purpose.

Any liability that cannot lawfully be excluded is, to the fullest extent permitted by law and subject to the final engagement terms, limited to the fees actually paid for the specific assignment giving rise to the claim. Nothing excludes liability that applicable law does not permit to be excluded.

No regulated professional advice

Unless expressly included through an appropriately qualified professional under a separate written arrangement, Aperture outputs do not constitute legal, investment, financial, accounting, tax, medical, clinical, engineering, scientific-certification or other regulated professional advice. The client must obtain the specialist advice required for the intended decision or use.

No court appearances, testimony or litigation obligation

Aperture Research Works, Paul Hattingh, Xandro Hattingh and contributors do not appear in court, arbitration, tribunals or regulatory proceedings, provide oral testimony, act as expert witnesses, authenticate evidence for formal admissibility, submit sworn expert opinions or accept an obligation to defend a research conclusion in proceedings.

Delivery of written work does not create any duty to appear, testify, provide continuing litigation support or respond to a subpoena. Any later written clarification or supplementary research is a separate assignment requiring express written acceptance, scope and fee.

Client acknowledgement

By proceeding with an assignment, the client acknowledges that Aperture provides research and decision support within an agreed written scope, not a guarantee, regulated professional opinion or transfer of decision-making responsibility.

Scope of the term

Evidence assurance is not certification.

Evidence assurance at Aperture means independent research, verification and documented human review. It is not statutory audit assurance, certification, attestation, legal approval or a guarantee of accuracy or outcome.

Method disclosure boundary

The public method cannot be treated as a complete process specification.

Only selected high-level principles and stages are disclosed. Thousands of internal process steps, decision rules, templates, taxonomies, source tests, review sequences, control logic, prompts, technical configurations and assignment-specific procedures remain confidential and proprietary.

The website and public case materials are not intended to permit reliable reconstruction, replication or reverse engineering of Aperture's underlying operating system.

Language and format

English controls the meaning of the work.

Clients may communicate in another language and may request an agreed translated final document. The English version remains authoritative and governing. Translation, PDF rendering and editable-document layout can vary, and Aperture Research Works is not responsible for changes or conversion errors introduced after delivery by the client or a third party.
