It does not claim Aperture would certainly have exposed the historical failure, and later evidence is not treated as though it was available at the earlier decision point.

The U.S. legal sequence must not be simplified into a claim that Boeing was convicted of the MAX fraud conspiracy. The public case distinguishes the charge, deferred-prosecution history, later breach determination, proposed plea developments, the 2025 non-prosecution agreement and dismissal of the charge.

Allegations, admissions, regulatory findings, settlements and adjudicated outcomes are not treated as interchangeable evidence categories.
